Ember1. Provider, Acceptance, and Effective Date
Ember is provided by Geordan Gesink, Haesselackerstraße 3, 69198 Schriesheim, Germany. Contact: support@emberalarm.com.
These Terms of Use and End User License Agreement (“Terms”) apply to the Ember mobile app, this website, and related services. By downloading, purchasing, or using Ember, you agree to these Terms. They are effective from August 23, 2026.
2. License and Scope
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Ember for your own lawful, non-commercial use on devices you own or control, subject to these Terms and the usage rules of the store from which you downloaded the app.
The app is licensed, not sold. No ownership rights in the software, branding, content, or services transfer to you.
3. Ember and Ember Pro
Ember is a consumer wake-up alarm app. It can keep an alarm active until you complete a wake-up check, such as a code scan, vocabulary recall, puzzle, math task, or short walk, and can track streaks and scores.
Some features are available through Ember Pro. Depending on your store and region, Ember Pro may be offered as a monthly or annual auto-renewing subscription or as a one-time lifetime purchase. The features, price, currency, taxes, and billing period shown in the App Store or Google Play purchase screen before confirmation control your purchase.
4. Subscriptions, Billing, and Renewal
- Payment is charged to your Apple App Store or Google Play account when you confirm the purchase.
- Monthly and annual plans renew automatically for the same billing period unless you cancel them through the relevant store before the renewal time shown there.
- Your store account may be charged shortly before a new billing period begins. Any price change is handled under the store's notice and consent rules.
- Taxes and currency conversion may vary by location and store account.
5. Free Trials and Promotional Offers
Eligible users may receive a seven-day free trial for a monthly or annual plan. Eligibility is determined by Apple or Google. Unless you cancel before the trial ends, the plan converts to a paid, auto-renewing subscription at the price displayed when you started the trial. Store-specific offer terms shown at checkout also apply.
Private-beta testers who request access receive First Light, six months of Ember Pro without charge when Ember launches publicly, and a permanent 70% discount on the Ember Pro Lifetime plan. The access code must be activated in Ember by the deadline shown in the access email. An unactivated code expires after that deadline, after which the tester may request another. Activating before the deadline reserves the benefits until the access is connected to an account. Benefits are limited to one account per access request, have no cash value, and are not transferable. The lifetime discount does not expire while that plan is offered, but availability, tax, and redemption mechanics can depend on region and app store requirements. The purchase screen shows the final terms before confirmation.
6. Lifetime Purchase
Ember Pro Lifetime is a non-consumable, one-time purchase that does not auto-renew. It provides non-expiring access to the Ember Pro features included with that purchase in this app, subject to these Terms and restoration through the same store account. It does not guarantee that every future product or separately priced service will be included, or that any digital service will remain available indefinitely. Mandatory consumer rights remain unaffected.
7. Cancellation, Restore, and Refunds
Manage or cancel a subscription in your Apple App Store or Google Play subscription settings. Cancellation normally takes effect at the end of the current paid or trial period. Deleting the app or an Ember account does not cancel a store subscription.
You can use Restore Purchases in the app to ask the store to restore eligible purchases associated with the same store account. Apple and Google process payments, cancellations, chargebacks, and refunds under their own rules. Refund requests must be made through the store where you purchased Ember Pro. Access may be removed after a refund, chargeback, or revoked transaction.
8. App Store Terms
Apple and Google are not parties to these Terms. Their store terms and usage rules also apply. We, not Apple or Google, are responsible for the app, maintenance, support, and handling claims about it, except where mandatory store terms say otherwise.
If you obtained the app from Apple, the license is limited to permitted use on Apple-branded products under Apple's Usage Rules. Apple has no obligation to provide maintenance or support. Where an applicable warranty cannot be disclaimed, you may notify Apple for any refund of the app purchase price available under its rules; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
9. Acceptable Use and Adult Audience
Ember is intended for adults aged 18 and over. Its simulated blackjack wake-up check does not involve real-money gambling, prizes, or anything of monetary value.
You must not:
- use the service unlawfully or to harm, harass, or deceive anyone
- interfere with alarms, security, infrastructure, or other users
- reverse engineer, copy, resell, scrape, or exploit the app except where applicable law expressly permits it
- bypass access controls, manipulate purchases or entitlements, or use fraudulent payment methods
You confirm that your use complies with applicable export-control and sanctions laws and that you are not prohibited from receiving the app.
10. Your Responsibilities
- Keep your device, store account, Ember account, and any configured emergency-override passkey secure.
- Check alarm volume, permissions, battery settings, schedules, and device compatibility before relying on an alarm.
- Use walking or other physical checks only where it is safe to move and pay attention to your surroundings.
11. Not a Medical or Safety-Critical Service
Ember is a consumer productivity tool, not a medical device, emergency service, or guaranteed safety-critical alarm. Alarm delivery depends on your device, operating system, battery, permissions, focus/do-not-disturb settings, network-dependent services, and platform limitations. Do not rely on Ember as your only alarm where late or missed waking could endanger a person or property.
12. Privacy and Intellectual Property
Our Privacy Policy explains how personal data is processed, including purchase and entitlement data. Ember software, branding, designs, text, and other materials are protected by applicable intellectual property law. Third-party materials remain the property of their owners.
13. Availability, Changes, and Termination
Features may depend on device capabilities, operating systems, app stores, and third-party infrastructure. We may update, add, remove, suspend, or discontinue features for product, technical, security, or legal reasons. We may restrict access where reasonably necessary to prevent abuse, fraud, security risks, or unlawful use.
You may stop using the service at any time. Removing the app does not cancel an active subscription; cancellation must be completed through the store.
14. Warranties and Liability
The service is provided “as is” and “as available” to the extent permitted by law. We do not promise uninterrupted, error-free operation or that a specific alarm will always ring. Nothing in these Terms limits mandatory statutory warranty or consumer rights.
We are liable without limitation for intent, gross negligence, injury to life, body, or health, and other liability that cannot legally be limited. For slight negligence involving an essential contractual duty, liability is limited to foreseeable, typical damage. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
15. Governing Law and Disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, without depriving consumers of mandatory protections in their country of habitual residence. The courts at Schriesheim, Germany have jurisdiction only where an agreement on venue is legally permitted, including for merchants and public-law entities.
16. Changes, Severability, and Contact
We may update these Terms for legal, security, technical, or material product changes. The current version and effective date are published here. If a provision is invalid or unenforceable, the remaining provisions remain effective. Questions can be sent to support@emberalarm.com.
