These Terms govern your use of the Ember app and this website.

1. Provider

Ember is provided by Geordan Gesink, Haesselackerstraße 3, 69198 Schriesheim, Germany. Contact: support@bonkalarm.app.

2. Scope

These Terms apply to all use of Ember, including the mobile app and this website.

3. Service Description

Ember is a wake-up alarm app that keeps ringing until you complete a wake-up check, such as a code scan, puzzle, math task, or short walk. It also tracks streaks and scores.

4. Not a Safety-Critical or Medical Device

Ember is a consumer productivity tool, not a medical device and not a guaranteed or safety-critical alarm. Alarm delivery depends on your device, operating system, battery, permissions, focus/do-not-disturb settings, and platform limitations.

Ember software, branding, and related materials are protected by applicable intellectual property law unless otherwise stated.

7. Service Availability and Changes

We may modify, suspend, or discontinue features for technical, security, or legal reasons. We may also update these Terms when required.

8. Disclaimer of Warranties

The service is provided “as is” and “as available.” To the maximum extent permitted by law, no warranties are made regarding uninterrupted availability, fitness for a specific purpose, or complete error-free operation, including that any specific alarm will ring.

9. Limitation of Liability

We are liable without limitation for intent and gross negligence. For slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable, typical damages. Mandatory statutory liability remains unaffected.

10. Termination

You may stop using the service at any time by removing the app. We may restrict or terminate access where necessary for legal, security, or abuse-prevention reasons.

11. Governing Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent legally permissible. If legally allowed, the place of jurisdiction is Schriesheim, Germany.

12. Severability

If any provision of these Terms is invalid, the remaining provisions remain unaffected.
